US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face human smuggling charges, he was held in federal detention.
In her order, the judge pointed out that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
